### **1. Introduction**
This **Terms of Service (“TOS”)** and **Acceptable Use Policy (“AUP”)** govern all customers (“You” or “Customer”) who use hosting services provided by **Lonethost (“We”, “Our”, “Us”)**.
By using Lonethost services, you acknowledge that:
– **Customers are solely responsible for their content, activities, and compliance with applicable laws.**
– **Lonethost does not monitor, control, or assume liability for customer actions.**
– **Lonethost provides infrastructure but is not responsible for how customers use it.**
### **2. Modifications**
We reserve the right to modify this TOS at any time by posting updates on our website. Continued use after changes indicates your acceptance.

## **3. Prohibited Activities and Content**
Customers **must not** use Lonethost services for:
– **Cybercrime**: Hacking, unauthorized access, fraud, identity theft, phishing, or stealing financial data.
– **Malware & Exploits**: Distributing viruses, spyware, or engaging in **DDoS attacks**.
– **Illegal Use of VPNs or Proxies**: Any usage intended to conceal identity for **criminal activity**, unauthorized access to systems, or financial fraud.
– **Child Exploitation & Terrorism**: Hosting or distributing **child abuse materials, extremist content, or terror-related activities.**
– **Intellectual Property Violations**: Hosting **pirated content, stolen software, or trademark-infringing materials.**
– **Scams & Fraudulent Schemes**: Ponzi schemes, investment scams, fake e-commerce sites, or impersonation.
– **Circumventing Security Measures**: Bypassing firewalls, abusing APIs, or probing networks without authorization.
– **Spam & Unsolicited Communications**: Sending mass emails, SMS spam, or abusive messages.
Lonethost **reserves the right to immediately suspend or terminate services** upon detection of prohibited activities, without prior notice or refund.

## **4. System Usage Restrictions**
– Customers may not interfere with server operations, attempt unauthorized access, or make configuration changes without approval.
– Customers must ensure software, scripts, and websites remain secure. Lonethost is not responsible for securing customer applications.
– Customers may not run game servers, VPNs, TOR nodes, cryptocurrency nodes, streaming services, or other high-bandwidth services without approval.

## **5. Reseller Responsibilities**
– Resellers are fully responsible for all activities originating from accounts they manage.
– Resellers must act on abuse reports immediately and terminate non-compliant users.
– Lonethost reserves the right to suspend all reseller-related accounts for unresolved abuse issues.

## **6. Compliance with Law & Cooperation with Authorities**
### **6.1 Customer Responsibility**
– Customers **must ensure their use of services complies with all applicable international laws.**
– Customers **must respond to abuse complaints** within 24 hours.
– Customers **are responsible for any damages resulting from their illegal use of services.**
– Customers acknowledge that **they are solely responsible for any actions taken using Lonethost services**, including criminal activities, unauthorized access, or financial fraud. Lonethost **shall not be held liable** for any consequences arising from misuse.
### **6.2 Government & Legal Requests**
– Lonethost **will comply with valid legal requests** from law enforcement agencies where required by applicable law.
– **Customer data may be shared if legally required**, including IP logs and payment transaction details.
– Lonethost **will not notify customers** if prohibited by law.

## **7. Account Suspensions & Terminations**
### **7.1 Immediate Termination for Abuse**
– We reserve the right to suspend or terminate services **without refund** if a customer engages in prohibited activities.
– Repeat offenders **will be permanently banned** from using our services.
– Lonethost **is not liable** for any losses resulting from suspension or termination.
– If an IP address assigned to a customer is blacklisted due to spam, abuse, or illegal activity, Lonethost **reserves the right to suspend or terminate the account** without prior notice.
### **7.2 No Refund Policy for Suspended Accounts**
– Services terminated due to **AUP violations are non-refundable.**
– Customers are **solely responsible** for backing up their data before termination.
– Lonethost **is not responsible for lost data** due to account suspension.

## **8. Payments, Billing & Refunds**
### **8.1 Payment Terms**
– All services are **billed in advance** on a recurring basis.
– **Non-payment results in service suspension** after the due date.
– Customers must ensure payments **are correctly processed** before service expiration.
### **8.2 No Refunds Policy**
– **Dedicated servers and domain registrations are non-refundable.**
– Refund requests for other services are handled **on a case-by-case basis** but are not guaranteed.
– **Disputing a payment (chargeback) will result in account suspension.**

## **9. Backups and Data Management**
– Customers are solely responsible for conducting regular backups.
– Lonethost is not responsible for lost, corrupted, or deleted data.
– Lonethost may remove infringing material without notice if required by law.
– Lonethost **does not guarantee data retention beyond the service period**. Data may be permanently deleted within **30 days of termination**.

## **10. Warranties & Service Disclaimers**
– Lonethost services are provided **“as is” without warranties** of any kind.
– We **do not guarantee 100% uptime** or uninterrupted service.
– **We are not responsible** for damages, financial losses, or legal consequences arising from the use of our services.
– Lonethost **utilizes third-party infrastructure** and is **not liable** for service disruptions caused by external providers.

## **11. Dispute Resolution & Arbitration**
– Any disputes arising from this TOS shall be resolved through **binding arbitration in a neutral jurisdiction**, in accordance with international arbitration standards.
– Customers waive their right to file lawsuits in courts and agree to resolve disputes exclusively through arbitration.
– Each party shall bear its own legal costs unless otherwise determined by the arbitrator.

– If any provision of this TOS is deemed unenforceable, the remaining sections remain valid.
– Lonethost’s failure to enforce any policy **does not waive its right to do so later.**

This TOS shall be interpreted and enforced according to the principles of **international law**, without reference to any specific jurisdiction. Any disputes shall be resolved in accordance with applicable laws governing international commercial agreements.
